Terms and Conditions for Clients Using Digital Album Creation Services:

Welcome to BigTimes.in (“the Website”). By using our digital album creation services (“the Services”), you agree to the following terms and conditions. Please read them carefully before proceeding. If you do not agree to these terms, you should not use the Services.

Eligibility:

• You must be at least 18 years old to use the Services. If you are under 18, a parent or legal guardian must provide consent.
• You must provide accurate and complete information when using the Services.

Service Description:

• BigTimes.in offers digital album creation services where we compile and design albums using the photos and content you provide.
• The quality of the final product depends on the quality of the images and content submitted by you.

Scope of Services

• The Service Provider agrees to create and store a digital album for the Client containing the photographs submitted or approved by the Client.

Duration of Storage

• The Client’s digital album will be stored on the Service Provider’s website for a minimum period of 10 (ten) years from the date of upload.
• After the 10-year period, the Service Provider reserves the right to review and extend the storage at its discretion.

Public Accessibility and Downloading:

• The digital album will be accessible in the public domain.
• Other users may view and download the photographs unless explicitly restricted by the Client during the agreement.
• The entire album link can be password-protected upon the Client’s request.
• The website may share photos and videos on its social media handles, such as Facebook, Instagram, and X.

User Content:

• You are responsible for the images, videos, and other materials you submit for the creation of the album.
• By submitting content, you confirm that you own the rights to the materials or have obtained necessary permissions.
• BigTimes.in is not responsible for verifying copyright ownership or liability for any unauthorized use of content.
• By using the Services, you grant BigTimes.in permission to use photos from your album for promotional purposes, including but not limited to social media posts and marketing campaigns.

Privacy and Data Security:

• Your content and personal information will be handled in accordance with our Privacy Policy.
• While we take precautions to secure your data, BigTimes.in is not liable for unauthorized access or data breaches caused by external factors.

Fees and Payments:

• All fees for the Services will be communicated at the time of booking and must be paid in advance unless otherwise agreed.
• Payments are non-refundable, except in cases where the Services are not delivered as agreed.

Delivery of Digital Albums:

• Digital albums will be delivered within the agreed time frame. Any delays will be communicated promptly.
• The final digital album will be provided in a format specified during the order process (online link).

Revisions and Modifications

• You may request revisions to the album design within a specified revision period (details provided during order confirmation).
• Additional revisions beyond the agreed scope may incur extra charges.

Cancellation and Refunds:

• Orders can be canceled within 24 hours of confirmation for a full refund.
• Refunds are not available once the design process has begun unless there is a failure to deliver the Services as agreed.

Limitation of Liability:

• BigTimes.in is not responsible for any loss or damage resulting from the use of the Services, except where such liability cannot be excluded under applicable law.
• The Service Provider shall not be held responsible for:

             -Loss or damage to photographs due to cyberattacks, hacking, viruses, or other forms of cybersecurity breaches.

             -Any technical failures or website downtime that may affect the storage or availability of the digital album.

• We are not liable for errors or delays caused by incorrect information or low-quality content provided by you.

Intellectual Property Rights:

• The Client retains the copyright of the photographs.
• By agreeing to public domain storage, the Client acknowledges that the photographs may be downloaded and used by others without the Service Provider’s intervention.

Indemnity:

• The Client agrees to indemnify and hold harmless BigTimes.in, its employees, and affiliates from any claims, damages, or liabilities arising from your use of the Services or breach of these terms.
• The Client agrees to indemnify and hold the Service Provider harmless against any claims, damages, or legal actions resulting from third-party use of the photographs.

Termination of Agreement:

• The Client may request the removal of the digital album at any time with prior written notice.
• The Service Provider reserves the right to terminate the agreement and remove the digital album if found in violation of applicable laws or website policies.

Modification of Terms:

• BigTimes.in reserves the right to update these terms at any time. Changes will be communicated on the Website, and continued use of the Services constitutes acceptance of the revised terms.

Entire Agreement:

• This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, written or verbal, relating to the subject matter.

Governing Law:

• This Agreement shall be governed by and construed in accordance in jurisdiction of Kamrup Metropolitan, Assam.
• These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in India.
